Description: Charging party alleged that employer violated HEERA by retaliating against him for filing grievances when it denied him reappointment rights and disability benefits; improperly reported his income to the Internal Revenue Service; and caused the U.S. Department of Homeland Security to investigate him.

Disposition: Dismissal affirmed.  The Board adopts the Office of the General Counsel’s warning and dismissal letters, which dismissed charges on the basis that the charges were untimely.  In addition, the Office of the General Counsel found that, even if the charges had been timely, charging party failed to state a prima facie case by alleging nexus between his protected activity and the employer’s alleged adverse actions.
