Description: Charging party alleged that union violated its duty of fair representation under the MMBA by failing to file a grievance challenging her termination by the employer.

Disposition: Dismissal affirmed.  Board adopted the Office of the General Counsel’s warning and dismissal letters as the decision of the Board itself.  The Office of the General Counsel dismissed the charge after determining that the charge failed to allege facts demonstrating that the union’s failure to file a grievance challenging the termination was without a rational basis or devoid of honest judgment.
