Description: The charge alleged that the Association breached its duty of fair representation by refusing to arbitrate charging party’s grievance over denial of his request for tenure and for allegedly colluding with the California State University in denying tenure.
Disposition: The Board affirmed dismissal of the charge, holding that charging party failed to allege facts sufficient to state a prima facie charge of a breach of duty of fair representation. Charging party’s appeal merely reiterates facts alleged in the unfair practice charge and restates arguments made to the PERB’s Office of the General Counsel, failing to state “the specific issues of procedure, fact, law or rationale to which the appeal is taken.”
