Description:  Charging party, a municipal employee, appealed the dismissal of his unfair practice charge alleging that his termination from employment violated the MMBA.

Disposition:  The Board agreed with the Office of the General Counsel that the charge included no facts indicating that the charging party’s termination was motivated by protected activity, or that charging party had presented facts to support any other cognizable theory of any unfair practice within PERB’s jurisdiction.  Accordingly, the Board rejected the appeal and adopted the dismissal of the charge.
