Description: The Office of the General Counsel dismissed an unfair practice charge alleging that the District failed to meet and confer with the charging party’s exclusive representative, violated the Education Code and the collective bargaining agreement, and terminated the charging party in retaliation for advocating on behalf of homeless students.
Disposition: The Board affirmed the dismissal, concluding that the charge failed to state a prima facie case and that the charging party’s appeal did not comply with PERB Regulations. Although the Board determined that certain allegations were incorrectly dismissed as untimely, this was harmless error, because they did not otherwise state a prima facie case.
