Description: A former school psychologist alleged that an employee organization had violated its duty to represent her in various disciplinary matters which led to her non-reelection for employment by a public school employer.  PERB’s Office of the General Counsel dismissed the charge as untimely and for failure to state a prima facie case and the former employee appealed, asserting various errors in the dismissal of her charge, including that the charge was timely because she was not an attorney and was unaware of the law governing that six-month statute of limitations.

Disposition: The Board adopted the dismissal, as the material allegations were alleged to have occurred more than six months before the charge was filed and no tolling or other exception to the statute of limitations was applicable.
