Description: Charging Party, a public school employee, appealed the dismissal of his unfair practice charge alleging that the exclusive representative violated its duty of fair representation.

Disposition: The Board affirmed the dismissal of the charge as untimely because the charging party did not file his charge until approximately one to three years after he first discovered respondent’s alleged misconduct.  The Board supplemented the dismissal, concluding that the doctrines of equitable tolling and equitable estoppel did not apply in this case, and that the charging party’s appeal did not comply with PERB Regulations.
