Description: Charging Party Teri Inez Harvey (Harvey), a former employee of Anaheim Union High School District, alleged that the California School Association & its Chapter 74 (CSEA) breached its duty of fair representation.  PERB’s Office of the General Counsel (OGC) dismissed the charge as untimely filed and for failing to state a prima facie case.  Harvey timely appealed OGC’s dismissal.

Disposition:  In a non-precedential decision issued pursuant to PERB Regulation 32320, subdivision d, the Board adopted the warning and dismissal letters as the decision of the Board itself and affirmed the dismissal of the unfair practice charge.
