Description:  Charging Party, a former employee of the Contra Costa Community College District, appealed the dismissal of his unfair practice charge.  Charging Party’s unfair practice charge alleged that his union breached its duty of fair representation by declining to file a grievance on his behalf, and failing to intervene when he was placed on medical leave and terminated.  The Office of the General Counsel dismissed the charge for failure to state a prima facie case.

Disposition:  The Board adopted the dismissal, as the alleged unfair practice failed to state sufficient facts to establish a prima facie case.
