Description:  Charging party excepted to the proposed decision of an administrative law judge dismissing his complaint and underlying unfair practice charge. The complaint alleged that the employer violated the Educational Employment Relations Act by issuing charging party a notice of suspension and then suspending him in retaliation for his protected activities. Following a formal hearing, the ALJ concluded that charging party failed to prove the employer engaged in unlawful retaliation.

Disposition:  The Board affirmed the dismissal of the complaint.
