Description:  Charging party excepted to the proposed decision of an ALJ.  The underlying unfair practice charge and complaint alleged that the employer took several adverse actions against the charging party because she engaged in protected activities.  At hearing, the ALJ granted the employer’s motion to dismiss the complaint after the close of the charging party’s case-in-chief, finding that the evidence did not establish a prima facie case of discrimination under the Meyers-Milias-Brown Act.  The ALJ subsequently issued a proposed decision on the same basis.

Disposition:  The Board affirmed the dismissal of the complaint and underlying unfair practice charge.
