Charging party may withdraw charge with prejudice after hearing on the merits. Charging party withdrew charge after employer returned employee to his prior position. Each reprisal case stands on its own set of facts and the employer is incorrect in arguing that withdrawal should be rejected because of application of a broad legal principle.
