Preliminary Rulemaking Activity:
At the April 9, 2026, Board meeting, the Board approved the modified proposed text of the regulations. PERB staff is now preparing the initial submission of the rulemaking package to the Office of Administrative Law.
Prior Activities:
At the April 9, 2026, Board meeting, the Division of Administrative Law will present modified proposed text for this rulemaking package for Board approval.

At the February 12, 2026, public meeting, the Board sent the proposed text to the rulemaking subcommittee for revisions. The subcommittee is revising the proposed text for presentation at a future public meeting.
PERB is currently developing regulations for requests for reasonable accommodations. The proposed text can be found here.
The Board will consider these regulations for approval at its February meeting.

- Written Comments: Please e-mail your comments to Chief Administrative Law Judge, Eric Cu (eric.cu@perb.ca.gov). We recommend submitting comments 5–10 days before the meeting to ensure the Board has time to review them.
- Verbal Comments: You may also speak during the public comment portion of the February meeting.
The Board discussed proposed changes to the text of the draft regulations at the December 9, 2021, February 10, 2022, and April 14, 2022 meetings. The Board approved the proposed text at the 4/14/2022 Board Meeting. PERB staff is preparing background materials in preparation of initiating the formal rulemaking process with the Office of Administrative Law.
