Chair Banks Issues 200th Authored Decision

Yesterday, Chair Eric Banks issued his 200th authored decision  –  Decision 2908E – United Teachers Los Angeles (Lukens, et al.). The Charging Party appealed the Office of the General Counsel’s dismissal of their charges. The Board affirmed the dismissal. They determined that the Charging Party failed to state a prima facie case and because a portion of the charges were untimely.

Banks’ issued his first decision over 11 years ago. In Decision 2310M – South Coast Air Quality Management District, the Board granted the South Coast Professional Employees Association’s request to withdraw their bad faith bargaining charge. The Association had resolved its dispute and executed a new memorandum of understanding.  The Board approved the request as consistent with the purposes of the MMBA.

Banks was a panel member on over 400 additional decisions beyond those he authored. Governor Edmund G. Brown, Jr. first appointed Banks to the Board in 2013. Governor Brown reappointed Banks in 2015 and again in 2017. In January of 2021, Governor Gavin Newsom designated Banks as Chair of the Board. Newsom reappointed Banks to the Board as Chair in January of 2022.
