Public Employment Relations Board (PERB) Privacy Policy

To carry out its statutory duties, PERB collects, uses, and maintains personal information. Personal Information is information that identifies or describes a person, including, but not limited to, his or her name, Social Security number, physical description, home address, home telephone number, education, financial matters, and medical or employment history. It also includes statements made by, or attributed to an individual within any documents filed with PERB. PERB, however, does not collect personal information from the users of its website.

Background

PERB’s policies, practices, and procedures for the collection and management of personal information are governed by law, including the California Information Practices Act (Civil Code section 1798 et seq.) and California Government Code section 11019.9.

Procedure

With some exceptions, individuals have the right to inspect and get copies of information about themselves that is maintained by PERB. Individuals also have the right to correct any inaccuracies in their personal information, such as a misspelled name. Requests for corrections should be sent to PERBQuestions@perb.ca.gov. Similarly, PERB is required to share certain personal information with the public under the California Public Records Act (Government Code Section 6250, et seq.) In particular, the California Public Records Act requires that PERB provide the requested information to a member of the public unless it falls under an exception.

PERB collects and maintains personal information through lawful means, and only to the extent needed to carry out its duties under each of the state’s eight labor-relations statutes that it enforces. At or prior to the time of collection, PERB specifies the purpose(s) for which personal information is collected, and any subsequent use of the data shall be limited to and consistent with the stated purposes. Moreover, PERB will not disclose, make available, or otherwise use personal information for purposes other than those specified at the time of collection, except with consent from the individual, or as authorized or required by law.

PERB is committed to safeguarding personal information. To that end, PERB uses security controls to protect personal information against loss, unauthorized access, use, modification or disclosure. In addition, PERB also:

  • Designates which position within PERB is responsible for the implementation of and adherence to this privacy policy;
  • Prominently posts this policy in its offices and on its internet website;
  • Distributes this policy to each of its employees and contractors who have access to personal data;
  • Complies with the Information Practices Act (Civil Code section 1798 et seq.); the Public Records Act (Government Code section 6250 et seq.); Government Code section 11015.5, and all other laws pertaining to information privacy.
