Transportation Network Company Drivers Labor Relations Act (TNC Act)
Codified at Business and Professions Code section 7470 et seq.
The TNC Act affords transportation network company (TNC) drivers the right to form, join, and participate in activities of TNC driver organizations, including to bargain collectively through such an organization, or to refrain from such activities. PERB is statutorily mandated to oversee certification, representation, and bargaining procedures under the TNC Act.

| Representation Determinations |
- June 2, 2026, California Gig Workers Union (CGWU), Case No. SA-TD-1-R. PERB determined that CGWU demonstrated support from at least 10 percent of active transportation network company drivers pursuant to Business and Professions Code section 7470.8(a)(1)(B). PERB also issued a Notice to Drivers for distribution by covered transportation network companies under section 7470.8(a)(3). [Ten Percent Support Determination Letter]
- August 7, 2026, California Gig Workers Union (CGWU), Case No. SA-PC-1-R. Pursuant to Business and Professions Code section 7470.8(b(1)(B), PERB has determined that CGWU provided evidence demonstrating proof of support from at least 30 percent of active transportation network company drivers. Consistent with section 7470.8, subdivision (b)(2), PERB shall wait 30 days, during which time a TNC driver may submit evidence that at least 30 percent of active drivers do not wish to be represented by any TNC driver organization. No driver organization is currently eligible to submit proof of support during this period.

September 9, 2026, California Gig Workers Union (CGWU), Case No. SA-PC-1-R. On September 9, 2026, pursuant to Business and Professions Code section 7470.8(b)(1) & (2), PERB certified the California Gig Workers Union (CGWU) as the certified driver bargaining organization for a statewide unit of all transportation network company (TNC ) drivers who drive for covered TNCs, based on evidence that at least 30 percent of active TNC drivers authorized CGWU to act as their bargaining representative. As the certified driver bargaining organization, CGWU now has the right to represent all TNC drivers in the unit and to bargain with covered TNCs over terms and conditions of work. Currently, Uber Technologies, Inc. and Lyft, Inc. are covered TNCs.
