1000.02029 – Disciplinary Action
Disciplinary procedures and criteria and other job protection proposals are within the scope of representation. (Healdsburg Union High School District and Healdsburg Union School District/San Mateo City School District (1984) PERB Decision No. 375, p. 69.) This includes proposals that require employers to show cause for imposing discipline. (Id. at pp. 69-70; accord Cerritos Community College District (2022) PERB Decision No. 2819, pp. 27-29; City of Davis (2016) PERB Decision No. 2494-M, pp. 28-30; Fairfield-Suisun Unified School District (2012) PERB Decision No. 2262, p. 12.) Indeed, investigatory and disciplinary procedures “lie at the core of traditional labor relations” and are “particularly amenable to collective bargaining.” (County of Sonoma (2023) PERB Decision No. 2772a-M, p. 24.) (pp. 26, 30.)
