Possession of any one of duties listed in Section 3540.1(m) or effective power to recommend such action through use of independent judgement is sufficient to make one a supervisor. Physical presence during entire work shift to observe work is not a condition precedent to a finding of supervisory status. Judgment required of employee in planning, scheduling and assigning work to subordinates not rendered routine merely because work of subordinates is manual labor. Employee organization can file simultaneous petitions for supervisor and non-supervisor units in same district. and non-supervisor units in same district.
