Where allegations in an unfair practice charge are clearly excluded from the grievance process PERB will not defer that portion of the case. However, the fact that the agreement provides an option to choose grievance procedures or PERB does not confer jurisdiction on PERB where the allegations are also covered by the agreement's arbitration procedures; pp. 6-8.
