A confidential employee must function as such in the regular course of his or her duties meaning that more than a fraction of the employee's time is spent on confidential matters dealing with employer-employee relations. Where very little of the employee's time is spent on matters that involve access to confidential information dealing with employer-employee relations, the employee does not function as a confidential employee.
