Newly discovered evidence standard is not appropriate grounds for reconsideration when the Board affirmed a Board agent's prehearing partial dismissal of an unfair practice charge; p. 5. Board determination that transfer of employees and positions from one unit to another was a transfer of unit work, not a bargaining unit modification, is unaffected by whether the transfer occurred prior to the Board's consideration. The actual occurrence of the transfer does not constitute "newly discovered evidence" under PERB Regulation 32410; p. 6. Board denies reconsideration when a party merely restates arguments previously considered by the Board; p. 7.
