750.01000 – In General

While it is true that the Trial Court Employment Protection and Governance Act (TCEPGA) permits an employer to adopt additional reasonable rules, it does not authorize rules that are in conflict with the Act. Rules adopted by the Court must not “frustrate the declared policies and purposes” of the Act. (International Brotherhood of Electrical Workers v. City of Gridley (1983) 34 Cal.3d 191, 202.) TCEPGA section 71637.1 does not permit a court to adopt a local rule prohibiting an employee organization from simultaneously representing units of non-managerial and managerial employees.
