In Regents of the University of California (2018) PERB Decision No. 2610-H, the Board explained that conduct is inherently destructive if its “natural and probable consequence” is to discourage protected activity, including but not limited to requiring employees to give up protected activity to receive a pay increase; maintaining an overbroad restriction that bars a mix of protected and unprotected activities; or implementing a wholesale replacement of represented employees with non-represented employees.
