605.01000 – Outright Refusal to Bargain

The County violated its duty to bargain when it flatly refused to bargain, to the extent of the discretion vested in its Board of Supervisor, over bylaw revisions on allied health professionals’ practice privileges. Even if the County had a good faith basis to doubt the extent of its bargaining duty, the County at least had a duty to meet with the union in good faith and seek to clarify, which it did not do.
