Board finds exceptions to be timely filed based on the five-day extension mandated by C.C.P. section 1013. In making this finding, Board overrules Lincoln U.S.D. (1978) PERB Order No. Ad-35, which held that C.C.P. section 1013 did not apply to PERB; pp. 405. PERB's regulations establish that the appeal period runs from the date of service of the proposed decision, then C.C.P. section 1013 applies if services occurs by mail; p. 6.
