The Board concluded that a stay of representation election pending the Board’s decision on an appeal of a dismissal of a decertification petition was not appropriate under the circumstances of this case. However, the Board further concluded that the purposes of EERA would be furthered by ordering that the ballots cast in the representation election be impounded pending the Board’s decision on the merits of the appeal.
