Decision 0142E – El Monte Union High School District

Petitions for recognition of units of summer school teachers and certificated hourly employees are construed, as a matter of equity, as a petition for unit modification. PERB changing policies, not errors by the petitioner, brought about the technically incorrect filings.

Home teachers, enrichment teachers, evening continuation high school teachers, driver training teachers and summer teachers added to existing unit of regular certificated employees. The newly added teachers hold credentials, perform duties comparable to regular day-time teachers and, in most cases, are drawn from the ranks of the day-time teachers.
