Description:  The complaint alleged that the District violated EERA when the District’s attorney purportedly represented the president of the National Education Association-Jurupa in a deposition noticed by Gillotte in an administrative proceeding he was engaged in against the District.

Disposition:  The Board affirmed the dismissal of the charge, holding that the District counsel’s explaining the mechanics of depositions to an employee non-party witness, who also happens to be a union officer, is not tantamount to providing support or legal advice to an employee organization.
