Description: Charging party alleged that the University violated HEERA by unilaterally changing the work shift of an employee without providing the Union with notice and an opportunity to negotiate.
Disposition: The Office of the General Counsel dismissed the charge after determining the Union had failed to show that the change in work shift had a generalized effect or continuing impact on terms and conditions of employment.
Finding that the University’s actions had a generalized effect or continuing impact on the bargaining unit, the Board reversed the dismissal and remanded the matter to the Office of the General Counsel for issuance of a complaint.
