Decision 2973M – Service Employees International Union Local 1021 (De Guzman)

SF-CO-536-M

Decision Date: July 11, 2025

Decision Type: PERB Decision (Non-Precedential)

Description:  Charging Party Albert De Guzman alleged that SEIU Local 1021 violated its duty of fair representation when: (1) it supported the decision of De Guzman’s employer, City and County of San Francisco, to change overtime procedure in a way that unfavorably impacted De Guzman; and (2) one of its representatives declined to help De Guzman file an unfair practice charge against SEIU. PERB’s Office of the General Counsel (OGC) found that De Guzman did not state a prima facie case of any MMBA violation and accordingly dismissed the amended charge.

Disposition: In a non-precedential decision, the Board affirmed OGC’s dismissal of the amended charge.
