Description: Cynthia Ruiz alleged that her bargaining unit’s exclusive representative Hughson Educators Association breached its duty of fair representation when it discontinued representing her after her contract grievance reached the arbitration stage. PERB’s Office of the General Counsel (OGC) dismissed Ruiz’s charge for failure to state a prima facie case of any EERA violation. Ruiz appealed.
