PERB has no jurisdiction to determine whether an employee covered under the Dills Act is supervisory as opposed to managerial or confidential. The portion of the Dills Act which covers supervisory employees is not administered by PERB. Section 3522.9 of the Dills Act grants to the State employer the authority to adopt rules for the administration of supervisory employees.
