Rulemaking Approved: Legislature Employer-Employee Relations Act
On June 30, 2026, the Office of Administrative Law filed PERB’s regulations with the Secretary of State (Notice File Number Z-2026-0120-04). New regulations concerning LEERA and associated definitional clarifications take effect July 1, 2026. Formal Rulemaking Activity:
On June 11, 2026, the Board approved the re-submission of the LEERA rulemaking package (for final approval) to the Office of Administrative Law to promulgate regulations applicable to the LEERA and associated definitional clarifications. There have been no modifications to the proposed text noticed to the public on February 6, 2026. On June 17, 2026, PERB re-submitted its final rulemaking package to the Office of Administrative Law.
Prior Activities:
On May 26, 2026, PERB withdrew its final submission from the Office of Administrative Law. The original text, without modifications, will be placed on the agenda for the June 11, 2026, Board meeting for additional considerations. Specifically, the Board will discuss the March 24, 2026, comment from the Office of Legislative Counsel, which is linked below. On April 15, 2026, PERB submitted its rulemaking package to the Office of Administrative Law for final approval. Any business or person submitting a comment regarding a proposed action has the right to request a copy of the final statement of reasons. This rulemaking package updates the Public Employment Relations Board’s regulations regarding PERB’s administration and enforcement of the Legislature Employer-Employee Relations Act. Staff is preparing the rulemaking package for its initial submission to the Office of Administrative Law. The LEERA takes effect July 1, 2026.
Preliminary Rulemaking Activity: At the February 13, 2025 Board meeting and the April 10, 2025 Board meeting, the Board considered comments from constituents concerning the LEERA rulemaking package. At the April 10, 2025 Board meeting, the Board approved the submission of a rulemaking package to the Office of Administrative Law to promulgate regulations applicable to LEERA and associated definitional clarifications.
