Notice of Proposed Rulemaking: TNC Drivers Labor Relations Act – Notice File Number Z-2026-0903-01
The purpose of these proposed regulations is to implement the Transportation Network Company Drivers Labor Relations Act (TNC Act). The Legislature established the TNC Act through Assembly Bill 1340 (Stats. 2025, Ch. 335), with an effective date of January 1, 2026. Codified at Chapter 10.7 (Sections 7470–7470.21) of the California Business and Professions Code, the TNC Act establishes a collective bargaining framework wherein transportation network company (TNC) drivers in the State of California are granted the right to form, join, and participate in the activities of TNC driver organizations (i.e., unions) with respect to terms and conditions of work, as well as the right to refrain from doing so.

Any interested person, or their authorized representative, may submit written comments relevant to the proposed regulatory action to the Board. The written comment period closes on November 3, 2026, which is 46 days after the publication of this notice. The Board will only consider comments received at the Board offices by that time. Preliminary Rulemaking Activity:
At the February 12, 2026, public meeting, the Board authorized submission of the rulemaking package to the Office of Administrative Law. PERB staff is preparing the rulemaking package for initial submission to the Office of Administrative Law.
PERB is currently developing regulations for AB 1340, the Transportation Network Company (TNC) Drivers Labor Relations Act. This law allows certain rideshare drivers to organize and bargain with Transportation Network Companies. The Board will consider these regulations for approval at its February meeting.

At the November 12, 2025, special meeting of the Board, the Board authorized the rulemaking subcommittee to consider revisions to the proposed text. A revised proposed text of the regulations will be considered by the Board at a future public meeting.
