Inaugural 10-day period to apply for designation as TNC Driver Organization opens January 20, 2026
On October 3, 2025, Governor Newsom signed Assembly Bill 1340, enacting the Transportation Network Company Drivers Labor Relations Act (TNC Act), effective January 1, 2026.
The TNC Act vests drivers with the right to form, join, and participate in driver organizations, to engage in collective bargaining, or to refrain from such activities. The Public Employment Relations Board (PERB) is statutorily mandated to oversee all certification, representation, and bargaining procedures under the Act.
Pursuant to the Act, the Board must designate a 10-day application period every quarter—commencing on or after January 1, 2026—during which entities may apply for, or renew, their designation as a TNC driver organization. PERB has officially noticed the application periods for 2026; the inaugural filing window will open on January 20, 2026, and close on January 29, 2026.
