October 2025 Board Decisions Summary
In October 2025, the Board issued two decisions. The decision descriptions and dispositions are below.
Organization: Service Employees International Union Local 1000 (Youakeem)
Case No. LA-CO-175-S
Issued date: October 1, 2025
Non-Precedential
Description: Nievien Youakeem filed an unfair practice charge alleging that Service Employees International Union, Local 1000 violated the Ralph C. Dills Act (Dills Act) by breaching its duty to fairly represent her in her employment relations with the State of California Employment Development Department. After PERB’s Office of the General Counsel (OGC) issued a warning letter, Youakeem amended her charge. OGC dismissed the amended charge for failure to state a prima facie case. Youakeem appealed.
Disposition: In a non-precedential decision, the Board affirmed the dismissal of Youakeem’s charge without leave to amend.
Employer: Temecula Valley Unified School District
Case No. LA-CE-6866-E
Issued date: October 30, 2025
Non-Precedential
Description: Charging Party Temecula Valley Educators Association, California Teachers Association/National Education Association (TVEA) filed an appeal from the partial dismissal of its unfair practice charge by PERB’s Office of the General Counsel (OGC). The charge, as amended, alleged that Respondent Temecula Valley Unified School District violated the Educational Employment Relations Act (EERA) and the Prohibition on Employers Deterring or Discouraging Union Membership (PEDD). TVEA alleged that the District violated EERA and the PEDD when District governing board members made comments at multiple board meetings disparaging TVEA, discoursing membership, and denigrating members’ participation in protected activity. TVEA also alleged that the District retaliated against certificated teachers who supported TVEA.
TVEA also alleged that the District violated EERA during a December school board meeting when board members discussed modifying or reducing a designated agenda item called “the spotlight” which allows TVEA representatives to address the school board. OGC issued a complaint for this allegation alone and dismissed the remaining allegations for failure to state a prima facie case. TVEA appealed.
Disposition: In a non-precedential decision, the Board denied the appeal. All claims made by Charging Party except for those in the August 28, 2025 complaint, that District governing board members voted to reduce “spotlight” time allotted to TVEA in violation of EERA, were dismissed without leave to amend. The Board remanded the matter to PERB’s Office of the General Counsel.
