Exclusive representative's right to file grievances in its own name is a nonmandatory subject of negotiations; insistence to impasse on a nonmandatory subject is a per se violation; p. 14-15, proposed dec. While the Association did not explicitly state that the proposals in question were "outside the scope of bargaining," the Association did make clear its contention that it was improper for the District to insist on language which it believed deprived it of its statutory rights.
