Reinstatement is not appropriate where the number of positions filled in any given year is dependent on the number of participating/beginning teachers in the Beginning Teacher Support and Assessment Induction Program and selections for the current year had presumably already been made; in such circumstances, the appropriate remedy in lieu of reinstatement is back pay.
