300.13000: UNFAIR PRACTICE ISSUES; PROTECTED ACTIVITIES; Holding Union Office
Serving as a union officer is protected activity. The Board overruled Trustees of the California State University (2009) PERB Decision No. 2038-H and similar decisions to the extent they held that an employee must allege “something more” than holding union office to show that he or she has engaged in protected activity under any PERB-administered statute. In Coast Community College District (1982) PERB Decision No. 251, the Board distinguished between the Carlsbad interference and Novato discrimination standards, but also explained that, employer conduct directed against union officials or organizers may be appropriately analyzed under either or both standards, as such conduct not only constitutes discrimination, but also “clearly interferes with the right of employees to form and participate in employee organizations.” (Id. at p. 20; Carlsbad Unified School District (1979) PERB Decision No. 89; Novato Unified School District (1982) PERB Decision No. 210.) Accordingly, under PERB precedent, and unlike private-sector precedent, such conduct may be deemed “inherently destructive” for either a discrimination or interference allegation. Under Santa Clara Valley Water District (2013) PERB Decision No. 2349-M, an employee’s role as a union officer constitutes protected activity irrespective of whether the employee exercises specific duties in that role. Thus, there is no categorical requirement that a union’s retaliation charge on behalf of a union officer necessarily allege specific duties the officer exercised. A charging party seeking to prove employer knowledge and nexus may be well-advised to introduce evidence of specific times a union officer exercised his or her role, but such evidence may not be needed if the charging party presents other strong evidence and the respondent is not able to present a persuasive non-discriminatory explanation for having taken adverse action. MMBA section 3502.1 guarantees substantive, enforceable rights to employees who serve as officers of the bargaining representative. While sections 3502 and 3506 operate in tandem to guarantee employee rights and make them enforceable through unfair practice proceedings, section 3502.1 contains both the prohibition against unlawful employer conduct and the source of the rights protected, i.e., the exercise of lawful action as a representative of an employee bargaining unit. Section 3502.1 was enacted to reinforce employees’ rights to serve as officials of the bargaining representative and to advocate positions against management practices without fear of reprisal. more or view all topics or full text.

Union president’s active role in union’s election campaign against successful mayoral candidate, including questions asked at city council meeting pursuant to a vote of the union’s membership and governing board, and writing a letter to the editor in the local newspaper that identified her as the union president, constituted protected activity because the union’s election campaign was a matter of employer-employee relations. A letter to the editor and recorded phone call critical of the successful mayoral candidate that identified the president only as a city employee were not protected activity because they were not part of the union’s election campaign and did not concern matters of employer-employee relations. more or view all topics or full text.
